For the thousands of Indian students arriving in the UK in September 2026, the degree is often just the start.
The ultimate goal is Indefinite Leave to Remain (ILR) and, eventually, a British passport.
But the 2026 reforms mean this path isn't automatic.
You need a strategic plan from the day you land.
At Indian Attorneys (UK), we help the NRI community navigate these transitions. Here is the step-by-step reality of the modern student journey.
The student years (Years 1–2)
Your journey starts the moment you arrive for your MSc or BSc. Time spent on a Student Visa doesn't count towards the five-year work route to settlement, but it is the foundation of your legal history.
The most important rule is 100% compliance. The 2026 Home Office audit systems now link university attendance registers directly to your visa records. You should also focus on your English proficiency early. While you only need B1 for your initial visa, hitting a C1 level can fast-track certain settlement applications later under the new rules.
The Graduate Route (The 18-month pivot)
If you start your course in January 2026 or later, the Graduate Visa is now limited to 18 months. This means you have a shorter window to find a licensed sponsor.
Don't wait until the end of your course to look for work.
UK employers in 2026 want candidates who are visa-ready and understand the New Entrant salary thresholds. Being able to explain that you can be sponsored at £33,400 instead of the standard rate makes you a much more attractive hire.
The Skilled Worker transition (Years 2–5)
This is when your five-year settlement clock officially starts. To keep that clock ticking, you must stay above the salary thresholds. For most, this means a minimum of £41,700, or £33,400 if you're still in the New Entrant bracket.
You also need to watch your time out of the country. You can't spend more than 180 days outside the UK in any 12-month period.
For NRIs, this requires careful planning around trips back to India to visit family. There's also a new 2026 requirement to prove at least three years of consistent National Insurance contributions when you eventually apply for settlement.
Reaching Indefinite Leave to Remain (ILR)
After five years on a qualifying work visa, you can apply for ILR.
The 2026 points system rewards high earners, particularly those making over £50,270, with faster processing times.
You'll need a clean legal record and to pass the Life in the UK test.
British Citizenship (Year 6)
Once you've held ILR for 12 months, you can apply for naturalisation.
Most Indian citizens transition to Overseas Citizen of India (OCI) status after getting their British passport. We can help you manage this transition to ensure you keep your property and inheritance rights back home.
Why you need a plan
The move from a lecture theatre to a British passport is full of paperwork traps.
A single mistake by your employer on the Sponsor Management System could reset your five-year clock to zero.
If you're planning your move for September 2026, don't just move for a degree. Move for a future.
