In 2026, RERA will be fully digitised across almost every Indian state. For NRIs who cannot physically visit construction sites, the RERA portal serves as your virtual eyes and ears, providing real-time updates on project progress, financial health, and legal compliance.

1. The RERA Registration Number: Your First Filter

Never invest in a project that does not have a valid RERA registration number. In 2026, even pre-launch marketing requires this number.

  • Verification: Visit the specific state's RERA portal (e.g., MahaRERA for Maharashtra, Karnataka RERA).

  • Data Access: By entering the registration number, you can view the sanctioned plans, the project’s bank account details (Escrow account), and the quarterly progress reports filed by the developer.

2. The 70% Escrow Rule

One of the greatest protections for NRIs is the mandatory Escrow account. Developers must deposit 70% of all collections from buyers into a dedicated account.

  • Usage: These funds can only be used for land and construction costs for that specific project.

  • Audit: In 2026, these accounts are subject to strict annual audits, ensuring your money isn't being diverted to start other projects, a common issue in the past.

3. Grievance Redressal from Abroad

If your builder misses a deadline or the construction quality is poor, you have the right to file a complaint without flying to India.

  • Online Filing: All RERA complaints are now filed through the official state portal.

  • Authorised Representative: You can appoint a lawyer or a trusted individual via a Power of Attorney to represent you in hearings.

  • Timelines: Most RERA authorities in 2026 aim to resolve disputes within 90 to 120 days.

  • Compensation: You are entitled to a full refund with interest (typically linked to the State Bank of India MCLR rate + 2%) if the project is delayed beyond the date specified in the Agreement for Sale.

4. Defect Liability Period

RERA provides a five-year warranty on your property. If any structural defects or quality issues arise within five years of you taking possession, the developer is legally bound to fix them at no cost to you within 30 days of your complaint.

5. Standardised Carpet Area

Before RERA, builders used confusing terms like “super built-up area" to inflate prices.

In 2026, all sales must be based on the Carpet Area (the actual usable floor space). This ensures you pay only for the area you can actually inhabit.
