The RNOR status is your most valuable tax shield during your return to India. Use this checklist to ensure you stay compliant and protect your global wealth.

1. Residency Proof & Timing

  • Verify the 9/10 Rule: Confirm you were a non-resident for at least 9 out of the 10 years before your return date.

  • Audit the 729-Day Limit: Ensure your total stay in India was 729 days or less during the seven years before your move.

  • Passport Stamps: Scan and store all pages of your current and expired passports to prove your physical presence history.

2. Financial Account Management

  • Convert NRE to Resident: Notify your Indian bank to convert NRE accounts to Resident accounts immediately upon arrival.

  • Open an RFC Account: Move your UK Pounds into a Resident Foreign Currency account to keep the interest tax-free under RNOR status.

  • Update NRO Details: Inform your bank to change your NRO account to a standard resident savings account.

3. Asset Liquidation & Tax Planning

  • Review UK Capital Gains: Plan the sale of UK properties or stocks within your RNOR window to avoid Indian tax on global gains.

  • Pension Assessment: Decide whether to keep your UK pension in the UK or transfer it under QROPS while your tax status is still in the buffer phase.

  • Declare Foreign Assets: Prepare your first Indian tax return with a full disclosure of your foreign assets to avoid penalties under the Black Money Act.

4. UK Compliance

  • HMRC P85 Form: File Form P85 with HMRC to tell them you are leaving the UK and to claim any overpaid tax.

  • National Insurance: Check if you should continue making voluntary Class 2 or Class 3 NI contributions to protect your UK State Pension.
