The year 2026 marks a major milestone in legal digitisation. In the UK, the Modernised LPA System is now fully operational, while in India, the focus has shifted toward Aadhaar-based e-Signs and Class 3 Digital Signature Certificates (DSC).

1. The UK Digital LPA (Lasting Power of Attorney)

If you need to manage assets or health decisions within the UK, the old paper-heavy system has been replaced by a digital-first model.

  • OneLogin Integration: You now create your LPA through the Government's OneLogin platform. This uses two-factor authentication and electronic identity verification (checking your passport or driving licence via smartphone).

  • Digital Signatures: The donor and attorneys can now sign digitally in most cases. However, a Certificate Provider still needs to virtually or physically witness the donor’s intent to ensure they aren’t being pressured.

  • Instant Verification: Banks and hospitals no longer require a physical paper deed. You simply provide them with a digital access code, and they can verify your authority on the official OPG (Office of the Public Guardian) register instantly.

2. The Indian PoA: Digital Drafting, Physical Execution

A common mistake NRIs make in 2026 is assuming they can simply e-sign a Power of Attorney for an Indian property sale. Under the Information Technology Act 2000, certain documents, specifically Wills and Sale Deeds for immovable property cannot be executed solely via digital signature.

  • The Hybrid Process: While you can draft the PoA digitally, the execution for property sales still requires a wet-ink signature. You must print the draft on plain paper in the UK, sign it before two witnesses, and then have it Apostilled by the FCDO or attested by the Indian High Commission.

  • Adjudication in India: Once the physical document reaches India, your attorney must have it adjudicated (stamped) at the Collector’s Office within three months.

3. Aadhaar e-Sign and Class 3 DSC

For non-property matters, such as managing an Indian bank account, filing taxes, or interacting with the Ministry of Corporate Affairs, 2026 has brought true digital authority.

  • Class 3 DSC: This is now the only active class of digital signature in India. It requires a mandatory video verification where a certifying officer cross-checks your face against your ID. This certificate allows you to sign electronic forms with the same legal weight as a handwritten signature.

  • Aadhaar e-Sign Expansion: If your Indian mobile number is linked to your Aadhaar, you can use e-Sign for various secondary legal documents and rental agreements. This is a game-changer for NRIs who need to sign documents without the cost of international couriers.

4. Safeguards and Fraud Prevention in 2026

With digitisation comes the risk of cyber-fraud. The 2026 framework includes new protections:

  • Digital Revocation: You can now revoke a digital authority as quickly as you granted it. A digital notice sent to the relevant portal can freeze an attorney's access immediately.

  • Transparency Alerts: Whenever your digital PoA or DSC is used for a high-value transaction, you will receive real-time SMS and email alerts from the Indian authorities.
